Severance packages are generally offered to employees whose positions are eliminated due to downsizing or restructuring. California does not mandate any kind of severance package from employers beyond the final pay.
Employees age 40 or older must be given 21 days to consider the employer's offer, unless it is part of a group termination. In a group termination, employees must be given 45 days. If the employee is younger than 40, there is no specified period of time which the employee must be given to sign the severance agreement.
The severance pay offered is typically one to two weeks for every year worked, but it can be more. If the job loss will create an economic hardship, discuss this with your former employer. The general practice is to try to get four weeks of severance pay for each year worked.
While no mandate requires employers to provide severance under California law, SB 331, signed into law in October 2021, introduced important provisions: Time to Review: You have a minimum of five days to review the severance agreement.
An executive severance package usually consists of a severance of one and a half to two times the executive's salary, plus target bonuses and health benefits for up to two years (“Executive”).
If you are the only worker being terminated, then you must be given at least 21 days to consider the agreement to waive your ADEA rights. If you are not the only worker who is being terminated, then you must be given at least 45 days to consider the waiver.
