What is the purpose of a BAA agreement?
In the most basic sense, a Business Associate Agreement or BAA is a legal document between a healthcare provider and a contractor. A provider enters into a BAA with a contractor or other vendor when that vendor might receive access to Protected Health Information (PHI).
What is a signed BAA?
With this PHI access, all business associates are required to sign what's called a business associate agreement (BAA). The BAA is a legal contract that describes how the business associate adheres to HIPAA along with the responsibilities and risks they take on.
Who needs a BAA agreement?
HIPAA requires Covered Entities to only work with Business Associates who assure complete protection of PHI. These assurances have to be in writing in the form of a contract or other agreement between the Covered Entity and the BA.
Does a BAA expire?
No, they do not expire. Once BAAs are in place, they are valid unless a regulatory rule change occurs.
Can Microsoft sign a baa?
Microsoft will sign a BAA but clearly states that simply having a BAA does not guarantee compliance with HIPAA Rules. By offering a BAA, Microsoft helps support your HIPAA compliance, but using Microsoft services does not on its own achieve it.
Are business associate agreements required?
The HIPAA Rules generally require that covered entities and business associates enter into contracts with their business associates to ensure that the business associates will appropriately safeguard protected health information.
Why do we need a business associate agreement?
A business associate is a third party who perform services or functions that require the use of or access to protected health information (PHI) to an entity covered by HIPAA. It can also be a subcontractor of someone who does business with you, when that subcontractor might have access to this same information.
Who needs a business associate agreement?
A Business Associate Contract, or Business Associate Agreement, is a written arrangement that specifies each party's responsibilities when it comes to PHI. HIPAA requires Covered Entities to only work with Business Associates who assure complete protection of PHI.

Do business associate agreements expire?
Many experts agree that BAAs should be reviewed at least once a year or more often if they expire, or if there are significant changes to the business relationship. When reviewing your business associate agreements, there are a few key points to pay close attention to: Expiration date.
