A Notice to Owner (TO) is a written notice prescribed by Florida Statute (713.06) that officially advises the owner of an improvement that the sender, usually a subcontractor or supplier not dealing directly with the owner, is looking to the owner to be sure the sender is paid before payment is made to the contractor
The short answer: Within 45 days (or before beginning work on a project). The long answer: Florida requires that a Notice to Owner must be sent within 45 days of beginning work on a project, or before the project starts.
The Notice of Commencement is effective for 1 year unless a different expiration date is specified. If a project is going to last longer than a year, a more realistic expiration date should be specified.
If the expiration date is coming up and the job is not complete, record an amended Notice of Commencement extending the expiration date. Payments that are made after an expired notice of commencement are improper payments and will not reduce the owner's exposure for liens.
In Florida, your Notice to Owner needs to be mailed within 45 days of when you completed your service or when you last received a payment. The notice must be served on the owner before filing the lien or within 15 days after you have filed the lien.
The filing of a Notice of Commencement by an owner or prime contractor can impact the deadlines and filing timeline for second tier suppliers and laborers. This can protect the owner because it creates a limit on when a lien can be filed, and limits the amount of liability for such a lien.

The Notice of Commencement also details who the owner is, how to contact the owner, who the general contractor is, and a description of the project.
