You might be given a volunteering agreement, but this is not the same as an employment contract. A volunteer doesn't get paid for their work. The key difference between a volunteer and a voluntary worker is that a voluntary worker performs duties under a contract. A contract means mutuality of obligation the organisation has an obligation to provide the work and the person has an obligation to perform the work.
Volunteers' rights You do not have a contract of employment as a volunteer, so you do not have the same rights as an employee or worker. You will usually be given a volunteer agreement that explains: the level of supervision and support you'll get.
As a volunteer, you have the right: To work in a healthy and safe environment. To be interviewed and engaged in accordance with equal opportunity and anti-discrimination legislation. To be adequately covered by insurance. To receive information about the organization, policies and procedures.
Most volunteers are competent and cooperative, so if you do a solid job throughout your screening process, firing them should be a very rare occurrence. Finally, firing should always be the absolute last resort the volunteer should have had ample opportunities to correct their behavior before termination.
The Volunteer Protection Act certainly does not mean that volunteers will be immune from suit. Nonprofit entities will continue to be sued as well, however, since they are likely to have “deeper pockets" and will still be liable for acts of their volunteer agents, even if the volunteers are not personally liable.
