If the paper being filed is not an adversary proceeding, the caption must state the number of the bankruptcy case, the name of the person named to be a party in the case, the case number, and a brief description of the paper being filed. Failure to comply with this Rule will have dire consequences. Failure to include information in the caption is grounds for dismissal. Failure to respond to a caption is grounds for dismissal. Failure to answer a caption is grounds for dismissal. Even where a request for an adversary proceeding is made, the case number must be included in the caption I. DATE OF FILING Rule 9004(b)(3) of the Federal Rules of Bankruptcy Procedure requires that all papers filed be filed within fifteen (15) days following the service of the summons. If the service is delayed, the date of service is the date on which the request is received. If a motion to set or intervene was filed the last day of the 15-day period, the date of filing must be the latest of the following: (A) the date the motion is served or (B) the first dusk date on which the motion has not been served with a copy of the document to which the motion relates. The time within which a document is to be filed may be extended to 30 days after the date of service I. DISPOSITION OF CURRENT CASE A bankruptcy case will be disposed of within 60 days after the date the person served with the complaint files a petition to dismiss the case or (within 45 days) if no petition is filed after discharging the petition III. DISPOSITION OF ALLEGED LIQUIDATION PREPARED TO BE FILED ON THE ACCOUNT OF AN ACCOUNT A bankruptcy case will be disposed of within 60 days of the date the person served with the complaint files a petition to dismiss the case under Rule 506(f) if the petition is without merit, or within 45 days of dismissal (Rule 506(u)) if no petition is filed after discharging the petition. V. EFFECT OF PROBATION AND PENALTIES A person who enters or attempts to enter into a bankruptcy proceeding is subject to criminal prosecution for violation of the civil provisions of Bankruptcy Code, 12 U.S.C. Section 632.
