RAPPER — MATTERS TO FOLLOW ADOPTED BY NSC ON JUN 30, 2003 Adopted in accordance with NSC 6A(a)(3), dated March 30, 2003: 1.1. This procedure is a continuation of the procedures for the issuance of NSC-approved Special Access Programs (SAP's) in accordance with Sections 1.9, 1.10, and 1.11. 1.2. The procedures shall establish that the NSC will provide each Special Access Program subject to the requirements of this document to the recipient (i.e., applicant) as a minimum service standard in conformance with the standards adopted pursuant to Sections 1.9 and 1.11 of this Appendix. 1.3. A Special Access Program may not have as its primary beneficiary a State, foreign government, foreign law enforcement agency, or any other U.S. Government agency. 1.4. If the NSC determines that a NSC-approved Special Access Program is to be used for purposes other than those specified in the NSC- approved SAP, the Special Access Program will require approval from the Secretaries of State and Energy and any other appropriate Federal agencies prior to its use. 1.5. Each Special Access Program shall be reviewed by the NSC Security Planning Staff at least twice per year, and the NSC Security Planning Staff shall recommend to the NSC the need to add to or subtract from the SAP's to permit access to sensitive information in accordance with the conditions set forth in this Appendix. 1.7. The NSC Administrative Director will, after a hearing and upon the recommendation of the NSC Security Planning Staff, revoke a Special Access Program, in whole or in part, when the NSC deems it necessary for the interest of national security to do so; provided that the NSC Security Planning Staff shall advise such Special Access Program of the grounds for revocation not later than 30 days after the end of the Special Access Program. 1.8. The NSC Security Planning Staff will review each Special Access Program submitted for approval prior to its use.
