Upon completion of a MSHA approved training program, such as experienced miner, task, or annual refresher training, you must record and certify on the 5000-23 form that the miner has received the specified training.
On April 18, 2024, MSHA issued its final rule, Lowering Miners' Exposure to Respirable Crystalline Silica and Improving Respiratory Protection, to reduce miner exposures to respirable crystalline silica and improve respiratory protection for all airborne hazards.
This form officially records and certifies a miner's completion of each training program required by Part 48, 75, and 77 training. All MSHA approved training programs must be properly recorded by an operator on an MSHA Form 5000-23 for each participant.
The rule requires operators to develop a written safety program for mobile equipment within six months of the effective date of the rule. It is effective January 19, 2024, but compliance through the creation of a written safety plan is not required until July 17, 2024.
7000-2. Quarterly Mine Employment and Coal Production Report. Mine operators and independent contractors are required to report employment and production information to MSHA using this form for each quarter of operation and at each mine at which activity is performed.
A Form 7000-1 shall be completed and mailed within ten working days after an accident or occupa- tional injury occurs, or an occupational illness is diagnosed. This report is required by law (30 U.S.C. §813; 30 C.F.R. Part 50).
MSHA's final rule requires mine operators to have written safety programs for surface mobile equipment (excluding belt conveyors) at surface mines and surface areas of underground mines. The safety programs must include input from miners and their representatives and identify hazards and risks.
