Plaintiffs are expellees in a cause of action for violation of W. Va. Code § 23-12.02 (a) (1989). Appellant is David Seabrook (John A. Fault of Seattle, J.J. Aaron son for Appealed) who wishes to be considered attorney in the state of Washington. The trial court denied the application to the circuit court. The Court of Appeals vacated, for nonappearance, the order denying the application, and this court reverses with directions. We hold that the office of the attorney general of Washington and its members and employees are subject to the disclosure requirements of W. Va. Comp.Laws § 23-13.02. We shall now consider whether Seabrook's application to the circuit court is a proper one to raise a claim of privilege. We will begin in general terms and then move to details. Possession of a power of attorney is of interest to the courts because it has constitutional implications. Washington Statutes, c. 22-1 (Supp. 1987). The Constitution and Constitution of this Commonwealth prohibit the attorney general from disclosing confidential information about a subject of an officeholder's care-taking to a party other than another attorney in the attorney general's office without prior consent of the attorney general. W. Va. Code § 23-12.02 (a) (1989).
