In order to avoid compliance with the requirements of sections 26, 26 U.S.C. 7206(1) and 6263, the real estate sales to the limited partnership were made through a series of numbered company names, each of which were registered to defendant VINCENT DEPENDING on the address of 1222 East Hunting Park Avenue in Philadelphia, Pennsylvania on a form numbered Exhibit A to this information. 4. During the period from April 25, 2014, until December 31, 2014, defendant VINCENT DEPENDING on failed to file a United States income tax return for those years under Title 26 of the United States Code to cover those sales of real estate as required by Section 6263 of the Internal Revenue Code of 1986, as amended. 5. On or about October 31, 2014, Mr. Edward F. D'Amato, an executive officer of The National Real Estate Fund, LLC, a Delaware corporation, served a summons and complaint on defendant VINCENT DEPENDING on the United States District Court for the Eastern District of Pennsylvania for violation of Section 26 U.S.C., Title 26, Code of Federal Regulations, 7206(a), (b), and (d), to which the United States, is a party, and an information was filed on that same day, which is a civil action to recover that tax. 6. At all times material to this information, defendant VINCENT DEPENDING on owned and operated Century 21 Direction Associates, 1222 East Hunting Park Avenue, Philadelphia, Pennsylvania. 7. Defendant VINCENT DEPENDING failed to make a genuine physical inventory of the property in her possession at the time of the sales which had been sold on or about October 31, 2014, and in violation of Section 6263 of the Internal Revenue Code of 1986, as amended. 8.
