How much does it cost to make a FOIA request? There is no initial fee required to submit a FOIA request, but the FOIA does provide for the charging of certain types of fees in some instances. For a typical requester the agency can charge for the time it takes to search for records and for duplication of those records.
It must be in writing and signed by the person making the request; It must state that the request is being made pursuant to the FOIA; It must reasonably describe the records being requested; It must state the category of the requester for fee purposes (i.e., commercial, media, educational, all other);
The FOIA does not require Federal Agencies to answer questions, render opinions, or provide subjective evaluations. Requesters must ask for existing records.
Federal agencies are required to disclose any information requested under the FOIA unless it falls under one of nine exemptions which protect interests such as personal privacy, national security, and law enforcement.
If the agency has difficulty connecting with the requester, the FOIA requires that it must make at least three good-faith attempts to do so. Once all these conditions are met, the agency will be able to charge all applicable fees for those requests where more than 5,000 pages need to be reviewed.
Information/data that is NOT covered by the Freedom of Information Act (FOIA) includes: Non-agency records and personal records. Public requests for access to physical artifacts or scientific samples (e.g. core samples, sediment, rocks, fossils, specimen samples, blood samples).
