FERPA requires that a consent for disclosure of education records be signed and dated, specify the records that may be disclosed, state the purpose of the disclosure, and identify the party or class of parties to whom the disclosure may be made.
(a) The parent or eligible student shall provide a signed and dated written consent before an educational agency or institution discloses personally identifiable information from the student's education records, except as provided in §99.31. (3) Identify the party or class of parties to whom the disclosure may be made.
Under FERPA, a school may not generally disclose personally identifiable information from an eligible student's education records to a third party unless the eligible student has provided written consent.
Generally, FERPA prohibits educational agencies from releasing any information in the education record unless they have written permission for the release. In most cases, a parent43 must sign that release.
FERPA serves a two-fold purpose: (1) to grant parents (and students 18 or older) access to information in the student's education record, and (2) to protect that information from disclosure to third parties without parental consent.
The U.S. Department of Education provides this guidance: “ 'Law enforcement unit records' (i.e., records created by the law enforcement unit, created for a law enforcement purpose, and maintained by the law enforcement unit) are not 'education records' subject to the privacy protections of FERPA.
Therefore, FERPA does not prohibit a school official from releasing information about a student that was obtained through the school official's personal knowledge or observation, rather than from the student's education records.
