Students in grades 6-8 may also be considered with an instruction schedule that meets the requirements of this section; these students shall be assigned to elementary, middle or high schools serving at least 3,000 students. Where the student is a special education student, with a documented disability that is the subject of a free and appropriate public education at the school, the student shall be assigned to the school in which the services are available, and provided services in accordance with the individualized education program established by the Board of Education for the needs of this student. A student shall not be placed in a school solely because of the type of school the student attends or the type of services rendered by the school, but only where the Board of Education approves that placement and the student has been given the opportunity for a free and appropriate public education under this section. The Board shall publish an official policy for consideration of these placement decisions in the North Carolina Bulletin and in any other appropriate statewide publication. SECTION 7. G.S. 115C-366 reads as rewritten: “115C-366. Student assignments. “(a) Unless the local superintendent of schools determines other arrangements in the best interest of the student, the school district, as set forth in subparagraph (7) of subsection (b) of this section, determines that a student shall be assigned to an elementary or secondary school of that district and provided the services at that school. The following shall control the assignment of a student to an elementary or secondary school based upon the student's domicile and the available services: “(1) Except as otherwise provided in this subdivision, the student shall be assigned to a school in that district which has at the time of filing the student's application for enrollment been classified as an elementary or secondary school serving at least 3,000 pupils with disabilities, and the Board of Education, by rule, shall prescribe the procedures for assignment of a student with a documented disability and other students meeting the requirements of this section to an elementary or secondary school in that district. “(2) Except as otherwise provided in this subdivision, the student shall be assigned to the school in the school district which the student would otherwise attend and be provided services, subject to subsections (b) and (d), if permitted under subsections (a) and (b), in accordance with the student's individualized education program established by the Board of Education.
