I do agree to provide the Warranty and associated Works and services in the form proposed and to do all the above as the Warranty is incorporated into this Contract by reference. No written warranty is offered or given hereunder. (1) Work in this Contract shall mean any work in the form of software, media, hardware and/or firmware, and the accompanying documentation (collectively, “Works”). Each of these Works shall comprise a separate Proposal of Work. (2) Service in this Contract means any service to be provided on the Services pursuant to the Terms, but excluding without limitation: (i) installation, maintenance, repair, update, update and/or security-related services; (ii) the provision of consulting and/or support services; (iii) any warranty service; (iv) any services to be provided by Tenderer's Authorized Representative on behalf of Tenderer or its Authorized Representatives; or (v) any third party service provider. I understand that, until Tenderer and I enter into a Work Purchase Agreement, we intend to agree on any reasonable scope of work for all of these Works. I acknowledge that the Services and any warranty provided in relation to such Services shall not be construed as limiting or exempting Tenderer from liability for any damage to, loss of data or profits from, or any other impairment of Tenderer's goodwill or reputation. (3) Work Proposal shall include all the following: (i) a detailed description of the work to be done; (ii) a statement of the type of Work being proposed; (iii) a reference to such Work in the contract documents of such other party (if any); and (iv) a list (excluding reference to the name of any other party) of such other party's Works, which may contain the names of other parties. In addition, if applicable, I understand and agree that Tenderer will provide Tenderer's Authorized Representative (including any of the Authorized Representative's affiliates) a copy of the Work Proposed by me and will make it available to such other party (if any), as applicable. I further acknowledge and agree that each such other party will promptly give Tenderer reasonable notice of the names of the Works that such other party has identified.
