II). 2. Plaintiffs seek damages, costs, and attorneys' fees. REBECCA J. WALPOLE, JUDGE: Plaintiff and Defendant jointly refer to their respective parent companies, The Reno Group and International Paper Products, Inc., who are named in this complaint. 3. Title IV of ERICA” governs federal employee pension and other employee benefits provided under the pension plan adopted and maintained by UNION PACIFIC, and/or its affiliates, in connection with the performance of the employees' Federal Government services. This suit is brought in the name of all current and former employees of the Reno Group and its affiliates. 4. On March 16, 2007, Plaintiff received a notice from UNION PACIFIC to commence collection of an overdue debt to its former Chief Pension Officer, in the amount of 2260.10. The notice included a demand for payment of the debt. Upon receipt of the demand for payment, the Plaintiff contacted UNION PACIFIC and demanded that the company cease collection activities against it. UNION PACIFIC refused. Plaintiff was subsequently served a Notice of Judgement in the amount of 2363.00 against “UNION PACIFIC” (a fictitious entity). Plaintiff filed this complaint. 5. Plaintiff's current principal residence is located in New York City, New York. 6. On or about February 13, 2006, UNION PACIFIC's director and its chief financial officer, Mr. Charles H. Dylan and Mr. Stephen J. McNeil, filed a Form 10-K in which they represented and stated that they were acting under a written agreement and contract between UNION PACIFIC and the Plaintiffs. As to this matter, UNION PACIFIC and its affiliates have entered into a written agreement and contract (the “Dylan Contract”). The Dylan Contract as presently presented is a settlement agreement to resolve the pending litigation between Plaintiff and UNION PACIFIC. 7. Upon review and consideration of all pertinent material facts and circumstances, the Court finds that the Dylan Contract is fair, reasonable, and reasonable under the circumstances, and that UNION PACIFIC's collection activity was unconscionable and unconscionable in light of its representation by its officer, Mr. Dylan, to its employees, and to persons outside its corporation, as discussed at length below. For the reasons herein given, the Court finds that UNION PACIFIC is liable to Plaintiffs for the damages and attorney's fees incurred as a result of UNION PACIFIC's collection activity. 8.
