Rule 45 contemplates an appeal on pure questions of law. A “question of law” arises when the doubt or difference arises as to what the law is on a certain set of facts, as opposed to a “question of fact,” where the doubt arises as to the truth or falsity of the alleged facts.
Draft an Answer. Pull the header information from the plaintiff's petition. Title your Answer “Answer to Plaintiff's Petition/Complaint.” Center this title and make it bold. Introduce yourself. Admit, deny, or claim that you lack sufficient knowledge to admit or deny each of the plaintiff's numbered allegations.
Federal Rule of Civil Procedure 45 does not provide a minimum time that a person has to respond to a subpoena. Largely, the timeframe is up to the issuing party. However, 30 days is generally seen as a reasonable amount of time. Of course, under certain circumstances, a shorter period of time could be allowable.
Any person who is at least 18 years old and not a party may serve a subpoena. Serving a subpoena requires delivering a copy to the named person and, if the subpoena requires that person's attendance, tendering the fees for 1 day's attendance and the mileage allowed by law.
The allowable length — 8,400 words or 30 pages — is set forth in rule 8.504(d). The petition's covers must be white (or blue, for an answer to a petition), as provided in Rule 8.40.
Begin with a short statement about the issues in the case for the California Supreme Court to consider. Clearly state your argument. Indicate if a petition for rehearing was filed in the Court of Appeal and, if so, explain how the Court of Appeal ruled on it.
The purpose of the rule is to reduce the burden of non-parties responding to a subpoena for documents by making the documents available to other parties without the need for additional subpoenas. The sharing of the document production should also reduce the cost to the parties of obtaining the information.
Follow Federal Rules of Civil Procedure Rule 45(b). Pursuant to Rule 45(d)(2)(B), the party has 14 days to respond after service of the subpoena, or the party must respond before the time specified for compliance in the subpoena if it is less than 14 days.
