The General Duty Clause, by definition, means that employers must protect employees from any serious hazard once they're aware of it – whether OSHA's rules specifically address it or not. That sounds pretty simple, but like everything about regulations and enforcement, it's a bit more complicated in practice.

Effective January 13, 2025, OSHA's new rule mandates that all PPE in construction must "properly fit" each affected employee. This change addresses long-standing concerns, particularly among women and workers with diverse body types, about the inadequacy of standard-sized PPE.
Section 5(a)(1) of the Occupational Safety and Health (OSH) Act of 1970 is commonly known as the General Duty Clause.
However, wherever OSHA standards require that employee training be conducted "at least annually," OSHA interprets that to mean that employees must be provided re-training at least once every 12 months (i.e., within a time period not exceeding 365 days.)
To issue a General Duty Clause citation, OSHA must prove: The employer failed to keep the workplace free of a hazard to which its employees were exposed. The hazard was recognized. The hazard was causing or was likely to cause death or serious physical harm.
The new regulations under the OSH Act addressed many specific hazards, but lawmakers knew that it didn't — couldn't — cover every possible risk in every circumstance. That's where OSHA's General Duty Clause, found in Section 5(a)(1), comes into play.
