7(a). (1) Subject to subsection (2), a person must not knowingly , use or maintain an optical surveillance device to record visually or observe a private activity to which the person is not a party, without the express or implied consent of each party to the activity.
The Surveillance Devices Act 2007 (NSW) (the 'Act') regulates the installation, use, maintenance and retrieval of surveillance devices in NSW. A 'surveillance device' means a data surveillance device, a listening device, an optical surveillance device, or a tracking device.
Section 8 makes it an offence carrying a maximum penalty of five years imprisonment to use a listening device 'to overhear, record, monitor or listen to' a private conversation to which the person is not a party or to record a private conversation to which there person is a party.
Surveillance Devices Act 2007 (NSW) The Surveillance Devices Act 2007 (NSW) (the 'Act') regulates the installation, use, maintenance and retrieval of surveillance devices in NSW. A 'surveillance device' means a data surveillance device, a listening device, an optical surveillance device, or a tracking device.
Generally, it is an offence to knowingly , use or maintain a tracking device to determine the geographical location of a person without their permission, or to determine the geographical location of an object without the permission of the person in lawful possession or having lawful control of that object.
Under s 8 of the Surveillance Devices Act 2007 (NSW), the use of visual recording devices such as video cameras is only prohibited where trespass on private premises is involved.
7 Prohibition on installation, use and maintenance of listening devices. (b) to record a private conversation to which the person is a party. : Maximum penalty--500 penalty units (in the case of a corporation) or 100 penalty units or 5 years imprisonment, or both (in any other case).
