Portability Election is a provision that allows a deceased spouse's unused estate tax exemption to be transferred to the surviving spouse, enabling the surviving spouse to use the combined exemption amount at the time of their death.
The executor or personal representative of a deceased spouse's estate is required to file the Portability Election if the deceased spouse's estate is eligible and the surviving spouse wishes to take advantage of the unused estate tax exemption.
To fill out the Portability Election, the executor must complete IRS Form 706, United States Estate (and Generation-Skipping Transfer) Tax Return, specifically indicating in Section C that they are electing portability of the exemption.
