The term “Biofuel Origin” means the primary fuel source for producing a fuel which, because of its physical and chemical composition, is used as a primary source of energy in transportation fuels or the production of electricity used in other processes, including, if so specified in a regulation, the primary fuel source for a product, whether the product is intended for the sale or use for sale of the primary fuel source.'' EPA is establishing a set of requirements for the biofuel production pathway which would identify the best method to generate the required minimum amount of renewable fuels per year. As long as the ethanol is sourced from a method that meets the biofuel pathway requirements, the production of renewable fuels can be used as part of the production of the “base diesel fuel'' to meet the requirement for Renewable Identification Number (IN) generation. In a notice published on June 15, 2003, the EPA stated that a fuel must derive at least 75 percent of its base emission factor and all other requirements from a renewable fuel that is biofuel in order to qualify for IN generation. Therefore, unless the biofuel is produced from a renewable fuel which has a IN of 50 percent or greater, the IN cannot be generated for the Biofuel Origin fuel. For example, if a facility converted to produce the required 100 percent ethanol from biomass sources, the facility could not generate the 10 percent IN. To meet the IN criteria, the ethanol could be blended into the base diesel fuel. (B) EPA may issue guidance to a plant to produce biofuel. As described above in the “Biofuel Origin'' section above, EPA has developed a specific guidance for the biofuel production pathway. The guidance sets out procedures for identifying renewable feedstocks and for separating them. If the renewable feedstocks are to be blended with base diesel fuel, they must undergo an evaluation which would be consistent with the guidance for blending of base diesel fuel to meet the Renewable Identification Number requirements. The guidance provides that the EPA must approve the fuel mixture and its blending if: (i) The fuel mixture is at least 75 percent for electricity and at least 50 percent for transport fuels, in accordance with the blending standards specified in the Guidance for the Biofuel Production Pathway published January 13, 2008 (62 FR 52388). (ii) The blending is intended solely to meet the Renewable Identification Number requirements.
