What is the I-864 form?

The I-864 is an affidavit of support that one signs to accept financial responsibility over an immigrant to the United States. The signee is usually a relative, who is willing to become the sponsor of the immigrant. The sponsor is usually the petitioner of an immigrant petition for a family member. The affidavit of support helps ensure that new immigrants will not need to rely on public benefits such as Food Stamps, Medicaid, Supplemental Security Income (SSI), and Temporary Assistance to Needy Families. The sponsor's responsibility usually lasts until the family member or other individual either becomes a U.S. citizen, or can be credited with 40 quarters of work (usually 10 years). Otherwise, form I-864 is legally enforceable.

Is the I-864 accompanied by other forms?

The I-864 is only one of the documents required to submit upon applying for a visa or residence application. The standard immigration forms (DS-260, DS-160, etc.) accompany the I-864.

Additionally, when sending the I-864, include:

  • A copy of your individual Federal income tax return including W-2s for the most recent tax year

  • Evidence describing why you were not required to file.

  • Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

Some of the features are prone to be misleading if you don't read through the how to documentation eg Send to Sign is not useful for everyone. Recommendations to others considering the product: Read through the documentation on how to use it What problems are you solving with the product? What benefits have you realized?
