Chief Emergency Planning Analyst, Federal Emergency Management Agency II.2.2.2.1.3 (10-01-2006) Hazardous Materials Identification and Certification and Certification and Other Requirements Section 2103 (relating to general requirements of rail carriers) was amended by Rail Passenger Transportation (Regulation of Dangerous Goods) Order No. 1742. In order to operate in the regulated passenger market within the United States: (a) An operator of a Class I or Class II track railcar used to transport hazardous materials within the United States and its territories, or an operator of a Class II track railcar who is engaged in transporting dangerous goods from a foreign country to a place in the United States, shall provide, within 30 days of the date of entry (or other reasonable date), the appropriate government agency with the following: (i) The first name and name under which the train operator, or the owner, shall be recognized under State law; or (ii) If this information is not available, the name under which this train operator, or the owner, shall be recognized under Federal law, or an alternative means of identification approved by the Department of Transportation. (b) The railroad shall supply each railcar operator, or the owner of the track railcar when it is operated on rail property, with an official Certificate of Authority: (i) Issued by the rail carrier that is responsible for the carriage of the hazardous material or materials; (ii) By which the rail car operator, or the owner, must show that the operator has the appropriate knowledge and technical skills to safely operate the track railcar; and (iii) To be retained by the railroad for a period of 3 years after its issuance. © The certificate and official records shall be maintained at the location where the track railcar is operated and at the office of a registered hazardous materials representative. (d) Each carrier conducting hazardous materials' transportation using a Class I or Class II track rail car shall maintain or designate a track railcar inspector or an employee in an approved hazardous materials safety program who will be available to inspect and maintain certificates and records to be used at the time the railroad applies for, and receives, approval by the Federal Railroad Administration for another Class I or Class II track railcar for the carriage of those hazardous materials.
