The Board for Correction of Military Records (“CMR”) denied petitioner's request for a reversal of the determination under “CMR Rule 33.” Petitioner's motion for leave to appeal pursuant to 28 U.S.C. §§ 2105 and 2106 has not been granted. Petitioner filed a joint statement supporting the filing of the appellate petition. The appellate petition raises several issues including denial of a motion to rescind the award, denial of post-hearing relief, denial of an opportunity for a hearing on the merits, denial of an opportunity to review the denial of a petition for review, denial of access to a transcript under the Military Selective Service Act's “Notice of Proposed Civil Rights Suit” requirements, and denial of an opportunity for a hearing on the issue of disability for purposes of Article 90 of the Constitution relating to military service. See Pet. App. 4-18. The Board is unable to reach the merits of the issues, and therefore DENIES the appeal. See § 4.1(b). The Secretary of Labor's interpretation as to how petitioner's status as a Department of Defense civilian employee should be evaluated is affirmed.
