The Open Public Records Act (OPRA) is a New Jersey law that governs public access to government records maintained by public agencies in New Jersey.
SECTION 1 – OPRA DEFINED What is the Open Public Records Act (OPRA)? OPRA is the State statute that replaces the old “Right to Know Law” which governs the public's access to government records in New Jersey. The law is compiled in the statutes as N.J.S.A. 47:1A-1 et seq.
OPRA is a state law that was enacted to give the public greater access to government records maintained by public agencies in New Jersey. Government records available from Legislative offices are primarily Legislative records.
The Alabama Open Records Law, § 36-12-40, Code of Alabama 1975, provides that “[e]very citizen has a right to inspect and take a copy of any public writing of this state, except as otherwise expressly provided by statute.”
Under OPRA, the custodian must respond to request "as soon as possible," but requesters must receive a response within seven business days after the custodian receives a complete request. That does not mean that a record in storage, or one that is difficult to find, will be available during that time.
Open Public Records Law – N.J.S. 47:1A-1 et seq. of this section. If a public agency can demonstrate that its actual costs for duplication of a government record exceed the foregoing rates, the public agency shall be permitted to charge the actual cost of duplicating the record.
OPRA provides that a custodian must permit access to a government record and provide a copy of the record(s) in the medium requested, if the public agency maintains the record in that medium.
