Who needs USCIS I-864?

01
Any U.S. citizen or lawful permanent resident who is sponsoring an immigrant for a visa or green card needs to fill out the USCIS I-864 form.

Who needs a I-864 form?

Under U.S. law, every person who immigrates based on a relative petition must have a financial sponsor that proves responsibility. The I-864 is a required affidavit for most family-based immigrants and some employment-based immigrants that intend to show they have an adequate financial support. The form assesses the sponsor’s financial stability and employment support, in order to prove that they are not likely to become a public charge.

What is the I-864 form?

The I-864 is an affidavit of support that one signs to accept financial responsibility over an immigrant to the United States. The signee is usually a relative, who is willing to become the sponsor of the immigrant. The sponsor is usually the petitioner of an immigrant petition for a family member. The affidavit of support helps ensure that new immigrants will not need to rely on public benefits such as Food Stamps, Medicaid, Supplemental Security Income (SSI), and Temporary Assistance to Needy Families. The sponsor's responsibility usually lasts until the family member or other individual either becomes a U.S. citizen, or can be credited with 40 quarters of work (usually 10 years). Otherwise, form I-864 is legally enforceable.

Is the I-864 accompanied by other forms?

The I-864 is only one of the documents required to submit upon applying for a visa or residence application. The standard immigration forms (DS-260, DS-160, etc.) accompany the I-864.

Additionally, when sending the I-864, include:

  • A copy of your individual Federal income tax return including W-2s for the most recent tax year

  • Evidence describing why you were not required to file.

  • Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

How do I fill the I-864 form?

The form is divided into eleven parts:

  1. Basis/Reason for filing for avidity support

  2. Information about the principal immigrant

  3. Personal data and information about immigrant that is to be sponsored

  4. Information about Sponsor

  5. Details about Sponsor’s household size

  6. Sponsor’s employment and income analysis

  7. Option declaration of Assets to supplement income

  8. Sponsor’s contract, statement, contact information, and signature

  9. Interpreter’s contract, statement, contact information, and signature

  10. If person preparing the Affidavit is not the sponsor, section 10 is where the individual should provide contact information, statement, and sign

  11. Any additional information

Where do I send the I-864 form?

What do you like best? The customer service on this software is unreal and so fast. I like the link to fill feature in this software, use it all the time. It's helpful for all our contracts and HR needs during a lockdown. What do you dislike? Some of the features are prone to be misleading if you don't read through the how to documentation eg Send to Sign is not useful for everyone. Recommendations to others considering the product: Read through the documentation on how to use it What problems are you solving with the product? What benefits have you realized? Having people sign documents during a lockdown is now a breeze. Having new interviewees fill out interview questionnaires, contracts and applications for employment so simple.
