As such this agreement is void and unenforceable in Texas, and the Artist is ineligible to receive any money or other consideration unless he or she enters into an agreement in writing with Fort Worth Hispanic Chamber of Commerce not to speak to or interact with plaintiffs, and agree not to promote Fort Worth Hispanic Chamber of Commerce or the Fort Worth Hispanic Chamber of Commerce Scholarship Fund in any way. Plaintiffs also maintain that their First Amendment rights, namely the right to express themselves without fear or favor is being violated by these contracts. To support their assertion that their First Amendment rights have been violated, plaintiffs point to the agreement between Artist and the Fort Worth Hispanic Chamber of Commerce as a potential violation of their First Amendment rights under the First Amendment to the United States Constitution.
