Medical Support Payments. Section A.01 is the key to determining medical support obligations in a Medical Support Circuit Court proceeding. Section B.01 establishes the minimum obligations for the support of each non-custodial parent and the support owed by the custodial parent. Section C.01 establishes the duties owed by the mayor parent to the payee parent, based on the nature of the parties' relationship. Section E .01 provides that payments are not subject to the income tax consequences of a tax period (if the parties are liable under federal income tax law), and this is the same rule as in a case involving the filing of a petition under Article IX of the Oregon Constitution or a petition for paternity under Section 11A.010. If the court determines in the proceeding under this subdivision (B)(2) that the medical support obligation of a mayor parent is less than the maximum amount set forth in the table, the court shall order the parties to make the least amount of medical support required to ensure payment of that lesser amount of medical support.
