Policy. It is the policy of the United States of America to make full restitution to the victim and make restitution of the full amount owed or due as a result of any violation of its laws by the offender, including any unpaid taxes, restitution, fines, penalties, forfeitures, interest, costs or attorney's fees. As further specified in sections 1601(b) and 1603 of the Victims of Immigration Crime Engagement Act (“VICTIM”), an offender may be required to pay restitution in an amount determined by the court at the time the offender receives notice of a judgment in an immigration proceeding as the result of an action brought by the Office of Immigration Litigation (OIL). However, the amount of restitution may not exceed the amount of any civil or criminal penalties imposed by the court on the offender or the amount that may be recovered through restitution ordered in an enforcement action brought by OIL under section 1715 of VICTIM, whichever is less. The United States will not request the restitution from the offender's spouse or children and will not seek to seek reimbursement from non-impaired United States persons. As used herein, ''restitution'' includes amounts not recovered in accordance with section 1715 of VICTIM and, more specifically, includes restitution made pursuant to a judgment for criminal contempt under 18 U.S.C. §§ 1621, 1623, or 18 U.S.C. § 1624 after completion of the sentence imposed by the court. Upon a finding by the court that an offender is unable to pay an amount for restitution, the State or a Federal agency shall be responsible for making payment thereof. The United States shall be responsible for making payment at the time the offender is notified of the court's finding that no funds are sufficient to pay restitution and for the collection and dissemination of funds. The United States will collect payment by a credit against the offender's civil forfeiture account in the Office of the Inspector General.
