If a landlord is trying to evict a tenant for not paying rent, the landlord must first give the tenant a three-day notice of nonpayment of rent. If the tenant pays within the three days, the tenant can stay.
Eviction. When a tenant doesn't respond to a UP notice and the court grants a default judgment in favor of the landlord or property manager, the tenant must leave within five days or be escorted off the premises by the sheriff.
What Happens After a 3-Day Notice to Pay or Quit? Once the tenant receives the notice, you will have to wait 3 business days. During this time, the tenant has a chance to pay you back. If they do not pay you back or respond to the notice, you can then file for an eviction.
