The law does not require a person to have a lawyer to create a separation agreement. Some spouses, citing expense, consider creating their own separation agreement without a lawyer. Separation agreements can be quite complex, as you might imagine.
If you have lived in the state long enough to meet the residency requirements, you will first need to file a petition for a legal separation. You have lived in NC for at least 6 months. You have been separated for at least 1 year. You do not want alimony or spousal support AND. You do not want a court-ordered division of property.
