DECIDE if you are going to contest (take action) or not contest (not take action) to resolve the DHS or SSA TNC case result. VISIT an SSA field office OR. WAIT for your employer to inform you of the final E-Verify case result.
An SSA or DHS Tentative Nonconfirmation (TNC) results when the information entered in E-Verify does not match SSA records or data available to DHS. A TNC does not necessarily mean that the employee is not authorized to work in the United States.
A Tentative Nonconfirmation (TNC) is received when either the Department of Homeland Security (DHS) or Social Security Administration (SSA) flags something entered on the I-9 as not matching their records. A “DHS TNC” or “SSA TNC” case result may occur because the employee's.
Generally, if the information matches, the employee's case receives an Employment Authorized result in E-Verify. If the information does not match, the case will receive a Tentative Nonconfirmation (TNC) result and the employer must give the employee an opportunity to take action to resolve the mismatch.
Verification in Process means that DHS cannot verify the data and needs more time. The case is automatically referred for further verification. DHS will respond to most of these cases within 24 hours, although some responses may take up to 3 federal government working days.
A Tentative Nonconfirmation (TNC) case is issued by either the Department of Homeland Security (DHS) or the Social Security Administration (SSA). Once referred, the employee has 8 federal work days to contact the DHS or the SSA. The employee must be allowed to continue working while he or she resolves the mismatch.
If the employee does not contest the TNC, or if the query ultimately results in a Final Nonconfirmation, you must terminate the worker's employment or face possible fines and penalties for knowingly continuing to employ an unauthorized worker.
A DHS or SSA TNC means that the information your employer entered in E-Verify from your Form I-9, Employment Eligibility Verification, did not match records available to DHS or SSA. A DHS or SSA TNC case result does not necessarily mean that you are not authorized to work in the United States.
