Modification of Custody or Support Orders Child Custody/Visitation Orders may be modified whenever the court finds it “necessary and proper” in the child's best interests [Ca Fam § 3022]. Typically, a parent must show a “significant change of circumstances” to support this modification.
If you and the other parent agree to change the child support order, you may not have to go to court for a hearing. Even if you and the other parent agree on the change, you still have to ask for the court's approval. To do this, you need to file a paper asking the court to approve the agreed change in child support.
How Do I Request Modification? Making a request only requires you to submit one form: Form FL-300, the Request For Order. Once filed with a court, the process will begin in earnest. You may also file Form FL-311, Child Custody, and Visitation, though this is optional.
Summons (Uniform Parentage—Petition for Custody and Support) (incl. Spanish) (FL-210) Tells the other parent of the child that a court case has started and what will happen if the other parent's response is not filed in 30 days. Get form FL-210.
If both parties agree to a change in support, they must complete and file a proposed Uniform Support Order (USO). The USO must be submitted to the court with up-to-date completed and signed Financial Affidavits for both parties, as well as a Child Support Guideline Worksheet and Personal Data Sheet.
The only possible way to avoid a mandatory custody modification hearing in California is if both parents agree on the proposed changes and write a new parenting plan to reflect those changes.
