Make your answers specific Try to avoid using generic terminologies that don't clearly highlight an applicant's characteristics or achievements. Ensure the feedback you provide in your reference is specific to the individual's performance and behaviour, using examples to highlight their strengths and achievements.
Marital Status, Family, and Children An applicant's marital status and family life, including current or planned children, have no place in a reference check. For example, if a hiring manager asks about a candidate's family and does not hire the applicant, the company could be liable for discrimination.
Be sure to include the name of the company, job, school, or opportunity for which the person is applying. For example, "I have been James Smith's supervisor at XYZ Company for the past five years. I am pleased to recommend him for the position of head accountant at ABC Company."
The answer comes in two parts. The first part is that the only questions a reference should ever answer are ones about job performance – and nothing else. The second part is a reference can say anything he or she wants to say – as long as it is (1) true or (2) an honestly held opinion.
There are no state or federal laws that prohibit an employer, a coworker, or anyone else from providing a poor reference for someone else. However, an employer may cross the line and face liability if he or she makes an untrue statement about an applicant's performance.
