The divorce process is relatively straightforward, and many people choose not to engage a lawyer to assist them with their divorce but rather, follow a 'do it yourself divorce' approach. There is no requirement in Australia (legal or otherwise) to engage a lawyer when applying for a divorce.
Applications for divorce should be eFiled online using the Commonwealth Courts Portal online form. This allows you, within the Court's secure website, to access your court file, the ability to eFile and access court orders 24/7. You may prepare your own divorce application or ask a lawyer to do it for you.
The filing fee for a divorce application (lodged with the Federal Circuit and Family Court) is $940 (as at 1 September 2021). If you hold a concession card or you cannot afford to pay the fee without financial hardship, you can apply for the fee to be reduced to $310 (as at 1 September 2021).
The filing fee for a divorce application which is paid to the Courts is $940. You are required to pay this fee at the time of application. You may also be eligible for a reduced fee of $310 (as of October 2021) if you hold certain government concession cards or you can demonstrate financial hardship.
