Tenants may do many undesirable things, but if there is no violation of the lease, the landlord cannot evict them for it. The legal eviction process begins when the landlord serves the tenant a written notice under Wis. ... 704.17 stating how the tenant has violated the lease. This may be a 5-day, 14-day or 30-day notice.
You have 5 days to respond and if you don't, the landlord can file for a Default Judgment or Possession. Once obtained they can request that the Sheriff evict you which usually takes 34 weeks to schedule and notice.
Failing to Pay Rent - Your landlord must first give you, the tenant, a written notice before you can be evicted. The notice must be in writing, and must give you 3 days to pay the rent or leave (vacate). The 3-day timeframe does not include weekends, holidays, or the day the notice is given.
The notice informs the tenant that the tenant must move out of the rental unit within three days of receiving the notice. The tenant is not allowed any time to fix the violation, and if the tenant does not move out within three days, the landlord can go to court to file an eviction lawsuit.
