An owner financing agreement includes purchase price, down payment, loan balance, interest rate, payment schedule, and starting and end dates. Make sure to include closing costs, late fee treatments, taxes and insurance responsibilities, and treatment in case of default.
If the buyer defaults, you should first attempt to achieve a mutual agreement with the buyer for either 1) completion of payment on the balance or 2) retaking control of the business. If an amicable resolution fails, you may consider the various dispute resolution alternatives discussed above.
The installment arrangement works like this: The contract states that the seller will keep title to the property until you pay off the loan. (You normally pay the loan off in a series of regular payments, similar to a standard mortgage.) After you do so, the seller signs a deed transferring title to you.
At the end of that period, a balloon payment is due. The expectation is usually that the initial seller-financed purchase will improve the buyer's creditworthiness and allow them to accumulate equity in the home. Once that happens, they can then refinance their payment to the seller with a traditional lender.
In exchange, the seller signs a deed transferring title to the buyer. In most cases, owner financing is a short-term arrangement, lasting five to 10 years (compared to 30 years for a traditional mortgage).
Typically, an owner finance transaction is set up using three documents. A promissory note outlining the terms of payment, a Warranty Deed with Vendor's Lien conveying title in the property to the buyer, and a Deed of Trust giving the seller the right to foreclose on the property if the buyer stops making payments.
After the deposit and monthly instalments, there's a final 'balloon' payment that, once made, will transfer ownership to you. At this stage, you can also choose to return the car, or many opt to use any left-over value towards a new car with a new PCP agreement.
