If a landlord is trying to evict a tenant for not paying rent, the landlord must first give the tenant a three-day notice of nonpayment of rent. The notice should tell the tenant how much rent is owed, and that the tenant has three days to pay it. If the tenant pays within the three days, the tenant can stay.
The most effective way to serve a notice of eviction is to send the notice via certified mail with a return receipt. After this is done, the notice of eviction is posted conspicuously on the property, such as the front door or garage.
In North Carolina, the county sheriff delivers the summons and complaint personally to the tenant. If the sheriff cannot deliver the documents for any reason, they may be attached to the front door of the property. The documents tell the tenant where and when the hearing of the eviction case will be.

30-Day or 60-Day Notices In most states, a landlord can give an eviction notice for a tenant to move without giving any reason. The time allowed under state law for such a notice is usually 30 or 60 days, but it may be as short as 20 days or as long as 90 days.
Step 1: Start by reading your rental agreement. This doesn't mean just skimming through it to get to the good parts. Step 2: Put your move out notice in writing. Step 3: Determine the best way to deliver your notice to vacate to your landlord. Step 4: Keep a record.
Include your name and the rental address, and date the letter. Don't date it and hold onto it; date it for the day you are giving it to the landlord to start the 60 days. Address the letter to the landlord with a subject line of “60-Day Notice to Vacate."
Dear (Name of landlord or manager), This letter constitutes my written (number of days' notice that you need to give based on your lease agreement) day notice that I will be moving out of my apartment on (date), the end of my current lease. I am leaving because (new job, rent increase, etc.)
