I liked that I can type in the blanks for documents , but I only needed it once and I didn't really didn't understand the price I though got it was $6 a month not $72. Proving Duress These include: The timeframe for contract performance to be completed by each party. The bargaining power each party had when the agreement was made. The mental state of each party at the time of the agreement.
In contract law, duress occurs when a person is influenced to sign a contract under pressure. Common examples of duress include threats to personal liberty, threats of actual violence (such as forcing a person to sign a contract at gunpoint), or excessive economic pressure.
Although there is no law in the United States stating that writing some form of under duress near your signature or somewhere on the contract will render the contract voidable, there are some sources that suggest this is a possible tactic.
Contracts can only be legally signed under a party's free will. Any type of coercion is considered duress if it allows one person to take advantage of another. Modification of a contract may also be done under duress.
Signature Under Duress: If one of the parties can prove that the contract was signed under duress, that is, the party's signature was extracted by physical or mental coercion, then the contract is null and void. Duress is defined as coercion of a party to execute a contract against the free will of that party.
Find out if and how an employer can make you sign a new contract. An employment contract must be agreed upon by both parties, and any attempt to force an employee to enter into a new contract is unlawful. An employer cannot change the terms of an employment agreement without letting the affected employee know.
Duress is wrongful pressure exerted upon a person in order to coerce that person into a contract that he or she ordinarily wouldn't enter. These contracts are void. No mutual assent exists. Other types of duress make a contract voidable, rather than void.
Answer: Your employer can't force you to sign the performance document, but there may be consequences for refusing to do so. For one, your employer could fire you for refusing to sign. However, putting your signature on the document doesn't have to mean that you agree with what it says.
