Right-to-work laws give employees the right to work for a company without being legally forced to join a union or other labor organization. Non-compete laws, which have been enacted in 47 states, can be enforced or overruled in court in right-to-work states.
A non-compete agreement is a contract between an employee and employer. A non-compete prohibits an employee from engaging in a business that competes with his/her current employer's business. While an employer cannot require you to sign a non-compete, they may terminate, or choose not to hire you if you refuse to sign.
Summing It Up. A noncompete agreement prohibits a former employee from working in a business that directly competes with the former employer. A nonsolicitation agreement may also stop the former employee from taking co-workers with him or her to another company.
