In the face of overwhelming scientific evidence and growing acceptance of the legitimacy and importance of jury nullification, the juror is now the subject of a new controversy, one as yet unresolved. As an institution, the American public remains divided between those who view the right of the jury to exercise a form of jury nullification and self-help as a means of self-preservation and others that view the right to vote as an inherent right and sacred duty. Such a division between the two groups is a fundamental violation of the fundamental right of the jury. This document recognizes the legitimacy of jury nullification. It is a way for the juror to exercise personal freedom. These Principles do not deny or negate the legitimacy of self-help or of other methods of self-preservation; they merely recognize the right of the jury and not any outside force to act as arbiter in its exercise nor for any outside force to dictate the content of the jury's deliberations. A properly functioning jury does not act for the convenience of the courts or for self-preservation on its own. It functions so that the people can make laws and regulations, and that the courts can make the laws and enforce them. While jury deliberations are an important part of the legal system, they do not operate in isolation. The American jury must be well-trained in the principles of jury system management, or it will be ineffective in its core mission.
