In the case of month-to-month leases, or if the tenant doesn't have a lease, then the landlord must give one rental period's notice before filing to evict. The next step is to prepare a summons and complaint, then file it in the district court where the dwelling is located.
Steps of the eviction process in Mississippi: Landlord serves tenant written notice. Landlord files complaint with court (if unresolved). Court holds hearing and issues judgment. Writ of execution is issued. Possession of property is returned to landlord.
If you don't have a written lease, your landlord should tell you how much rent you must pay and when it is due. If you don't pay your rent, your landlord has the right to start the eviction process. Your landlord must go to court to legally evict you.
In Missouri, if a tenant violates any portion of the lease agreement, the landlord must first give the tenant a ten-day notice that states the tenant has ten days to move out of the rental property or the tenant will be evicted. The landlord is not required to give the tenant any time to fix the lease violation.
For a tenant with no lease or a month-to-month lease in Tennessee, the landlord must serve them a 30-Day Notice to Quit to end the tenancy. This eviction notice allows the tenant 30 calendar days to move out. This notice applies to all counties in Tennessee.
