Standard Land Contract

What is a standard land contract?

A standard land contract, also known as a contract for deed or an installment sale agreement, is a legal document used in real estate transactions. It outlines the terms and conditions of a sale between a buyer and a seller, where the buyer agrees to make payments directly to the seller over a period of time, instead of obtaining a traditional mortgage from a lender. The seller retains legal title to the property until the buyer completes all payments, at which point the title is transferred to the buyer. This type of agreement allows individuals who may not qualify for traditional financing to purchase property and become homeowners.

What are the types of standard land contracts?

There are several types of standard land contracts that can be used depending on the specific needs and circumstances of the parties involved. Some common types include: 1. Straight Land Contract: In this type of contract, the buyer agrees to make regular payments to the seller over a fixed period of time until the full purchase price is paid. 2. Balloon Payment Land Contract: This type of contract requires the buyer to make regular installment payments for a specific period of time, with a large final payment, known as a balloon payment, due at the end of the contract term. 3. Wraparound Land Contract: In this type of contract, the buyer takes over the existing mortgage on the property, making payments to the seller, who in turn makes the mortgage payments to the original lender. This allows the buyer to avoid having to obtain their own financing.

How to complete a standard land contract

Completing a standard land contract involves several steps to ensure a smooth transaction. Here is a general outline of the process: 1. Negotiate and agree on the terms: The buyer and seller should negotiate and agree on the purchase price, payment schedule, interest rate (if applicable), and any additional conditions or contingencies. 2. Draft the contract: The contract should be drafted, clearly stating the agreed-upon terms and conditions. It is recommended to seek legal advice during this process to ensure compliance with local laws and regulations. 3. Review and sign the contract: Both parties should carefully review the contract and make any necessary revisions or clarifications. Once satisfied, the contract should be signed by both the buyer and the seller. 4. Record the contract: Depending on local laws, the land contract may need to be recorded with the appropriate government agency to establish a public record of the transaction. 5. Make payments and fulfill obligations: The buyer is responsible for making timely payments according to the agreed-upon schedule. The seller must fulfill their obligations, such as providing clear title to the property. 6. Transfer of title: Once all payments have been made and all obligations fulfilled, the seller will transfer the legal title to the buyer, completing the land contract transaction.

PDFfiller is a great tool to use for editing and templates PDFfiller allows me to utilize the same forms frequently. As a result, templates or refillable forms ensure document preparation is quicker and more efficient. Cloud security, ability to easily create templates for commonly used forms, flatten forms after fields filled in when saving to hard drive, in PDFFiller form remains in tact and is editable for reuse, and menu set-up. I wish PDFfiller would add the ability to add pages to a documents and allow downloading of templates created. Currently, in personal account, PDFfiller allows emailing to recipient to update information in fields, but doesn't allow me to download my template to my hard drive.
