How do I store i9 forms?

Storing the Original Paper Form I-9 Employers who choose to keep paper copies of the documents their employees present may store them with the employee's Form I-9 or with the employees' records. However, USCIS recommends that employers keep Form I-9 separate from personnel records to facilitate an inspection request.

How should I 9 forms be stored?

I-9 forms should always be maintained separately from personnel files and retained according to the U.S. Citizenship and Immigration Services (USCIS) retention requirements: “I-9 forms should be retained for three years after the date of hire, or one year after the date employment ends whichever is later.” The Form I-9

Can I 9 forms be kept electronically?

Employers may choose to scan and upload the original, signed forms to retain them electronically. Once these Forms I-9 are securely stored in electronic format, the original paper Forms I-9 may be destroyed. Never mail Forms I-9 to USCIS or ICE.

Do you need to keep copies of i9 documents?

If you do not participate in E-Verify, you are not required to make copies of documents. Some employers retain copies of documents for legal defense purposes. If copies or electronic images of the employee's documents are made, they must either be retained with the Form I-9 or stored with the employee's records.

Do I 9 forms expire?

No. Expired documents are no longer acceptable for Form I-9. However, you may accept Employment Authorization Documents (Forms I-766) and Permanent Resident Cards (Forms I-551) that appear to be expired on their face, but have been extended by USCIS.
