Most employers in regulated industries are required to perform pre-employment drug tests. Private-sector, non-regulated employers are not required to conduct pre-employment drug tests but can do so as long as they comply with state and local laws.
An employer can ask an applicant about current illegal drug use (not an ADA disability), but generally cannot ask about lawful (prescription) drug use, which may relate to a disability.
Before the applicant is even hired, the employer may already require that the applicant undergo a drug test as a pre-requisite to employment. It must be made part of the letter or the pre-employment contract, which must then be signed by the interested applicant. DOJ Opinion No. 61, 1998 is instructive on this matter.
The confirmatory laboratories use either GC-MS or liquid chromatography-mass spectrometry (LC-MS) for drug testing. Three of these laboratories are run by law enforcement or drug enforcement agencies (i.e. Philippines National Police, Philippine Drug Enforcement Agency, and National Bureau of Investigation).
Also, if you refuse a pre-employment drug test, the employer can refuse to hire you, even if you are the most qualified candidate. In other words, the employer has the right to implement a drug testing policy and, in most situations, has final say regarding what happens when you don't take the test as requested.
In many states, employers have the legal right to test job applicants for drugs or alcohol provided the applicants know that the testing is part of the interview process for all employees. In most situations, the testing cannot be conducted until the applicant has been offered a position.
