Maryland became the eleventh state1 (in addition to the District of Columbia) to adopt a statewide family and medical leave program (the “Program”). The Maryland General Assembly recently concluded its 2023 session and passed modifications to the Program. The governor approved the modifications on May 3, 2023.
The Program applies to all employers with at least one employee in Maryland and is funded by contributions from employers and employees. Eligible employees may receive up to 12 weeks of paid family and medical leave per benefit year for any single reason under the Program.
In April 2022, Maryland enacted the Time to Care Act which provides an eligible employee with up to 12 weeks of paid leave for baby bonding, to care for a family member, for one's own serious health condition, or a qualifying military exigency.
The FMLA defines a serious health condition as an illness, injury, impairment, or physical or mental condition that involves either inpatient care or continuing treatment by a health care provider. Both physical and mental health conditions qualify for FMLA leave.
