In many states, employers have the legal right to test job applicants for drugs or alcohol provided the applicants know that the testing is part of the interview process for all employees. In most situations, the testing cannot be conducted until the applicant has been offered a position.
An employer can ask an applicant about current illegal drug use (not an ADA disability), but generally cannot ask about lawful (prescription) drug use, which may relate to a disability.
Most employers in regulated industries are required to perform pre-employment drug tests. Private-sector, non-regulated employers are not required to conduct pre-employment drug tests but can do so as long as they comply with state and local laws.
A good substance abuse policy clearly outlines and explains the processes, guidelines, and rules of using, manufacturing, or distributing illegal or prescribed drugs, and/or alcohol while on duty. The policy should include a purpose, scope, workplace rules, testing requirements, and disciplinary action.
Whenever employees are working, are operating any [Company Name] vehicle, are present on [Company Name] premises or are conducting company-related work offsite, they are prohibited from: Using, possessing, buying, selling, manufacturing or dispensing an illegal drug (to include possession of drug paraphernalia).
The test may be done at the employer's location, or you may need to go to the testing company's location. The test will usually involve taking a sample of your saliva or urine (sometimes blood or hair, but this is less common). The sample will be collected by a person who's with you when you provide it.
