Can you start work without a contract?

Starting work without a signed contract means that your position isn't clear, or even worse it's weak. It also means that the contract is legally enforceable and will be able to support you if you decide to take legal action.

What happens if you do not have a contract of employment?

In the absence of a written employment contract that provides the employer the ability to make such changes, an employee may be entitled to refuse the changes and sue the employer for constructive dismissal claim. This means that the employer may be forced to pay wrongful dismissal damages.

What happens if you don't have an employment contract?

A contract can be broken if either you or your employer doesn't follow a term in the contract. This is known as a 'breach of contract'. For example, if you're dismissed and your employer doesn't give you the amount of notice you're entitled to under your contract, this would be a breach of contract.

Is it illegal to not have a contract?

No. Many activities and services don't require a contract. Even with employment, many employer-employee arrangements exist without a contract. And where contracts are expected for example, if you're working as an independent contractor and not as an employee it's not illegal to not be given a contract.

Do you have to have I written contract of employment?

Regardless of your employment status, if you're working, you should have an employment contract. While most employment contracts are in writing, they can also be verbal agreements. Oral contracts have the same legal authority, but it can be much harder to prove.

Is it OK to work without a contract?

Terms may be agreed orally, and not committed to writing but, they will still be legally binding on the parties. If you've never been given a written copy of your contract of employment, don't worry you will still have a contract, but its terms will be implied and/or agreed orally.
