How long does an attorney review take?
The attorney review period lasts three days and begins when each party receives a copy of the fully signed contract of sale. Weekend days and holidays do not count as one of the days of the review period.
Can a buyer back out during attorney review?
The contract is in the five-day attorney review period. During this time, the seller's attorney or the buyer's attorney can cancel the contract for any reason. This allows either party to back out without consequence. Although the seller can legally back out during an attorney review period, it's not very common.
Can you cancel a contract during attorney review?
During the attorney review period, either party can cancel the contract for any reason. That means that, if you decide you don't want to buy anymore, you can cancel the deal. It also means that, if the seller gets a better offer, they can kill the deal with you and sell to the new buyer.
How long does it take to get out of attorney review?
Attorney review ends when the attorneys for buyer(s) and seller(s) have completed their revisions and approved each other's revisions. That could be in 3 hours, 3 days or 3 weeks or any other time period imaginable. During this time both buyer(s) and seller(s) are vulnerable.
Can buyer back out before closing?
Depending on your reason for backing away from a home purchase and the terms of your contract, you may not get all or any of the earnest deposit money back. If you do not get the results you desire from an inspection, you should be able to back out of buying the house without losing money or any other consequences.
What happens when a buyer pulls out?
Once contracts have been exchanged, the buyer is legally committed to paying the price stated in the contract. If the buyer pulls out of the sale after contracts were exchanged, you can sue them for any loss this causes you, and you may be able to keep the deposit. You will need to get legal advice.
