Originally Answered: So, apparently, recording a song from a radio using a tape recorder is fair use. This is not illegal because copyright laws specifically made an exception for exactly this act (analog recording of radio-wave broadcast media). Audio Home Recording Act on Wikipedia.
In the United States, then once a song has been recorded and released, then anyone can record and release their version of the song, without permission. Outside the United States then generally you will need the permission of the copyright owner to record the song, and of course a royalty will be payable.
To be able to release your you'll need something called a Mechanical License. This is the permission you need from the publisher for you to record and distribute the song that they own the rights to. Anyone can cover and record a song that is in the public domain without permission.
Get the licenses which let you record and release the original composition. Get an International Standard Recording Code (SRC) to distinguish your cover version from anybody else's. Make sure you are set up to receive performance royalties.
If you want to record and release your own cover version of someone else's song, then you'll need a mechanical license for your cover song. A mechanical license is the right to make copies of the song's musical structure such as the lyrics and notes, which is called the musical composition.
