How do I get a copy of a sealed record?
There are few different ways to obtain a copy of your criminal record. The best way to obtain the most accurate information is to request a copy of your criminal record from the FBI or your state bureau of investigation, state police, or state public safety office. You may be required to submit your fingerprints.
Do I have to disclose a sealed record?
An expungement ordinarily means that an arrest or convictions “sealed,” or erased from a person's criminal record for most purposes. After the expungement process is complete, an arrest or a criminal conviction ordinarily does not need to be disclosed by the person who was arrested or convicted.
Will a sealed record show up?
Sealed records are technically still there, but they are no longer part of the public record and can only be accessed and reviewed by way of a formal court order. Expunged and sealed records can sometimes show up on criminal background checks.
Who can view a sealed record?
For the most part, private employers, landlords and others who perform a background check on you will not find your expunged records. After your record is expunged, in most states you are legally permitted to answer “no” when asked about criminal records on employment or rental applications.
Can Immigration see a sealed record?
The short answer is no for a sealed record, but likely yes for an expunged record. If you seal a criminal record, it does not erase it for immigration purposes. There are a few instances where DHS does not need a criminal conviction for a crime in order to argue that you should be deported because of it.
