What are the age requirements to adopt? For domestic and international adoptions, the age of the prospective parents must be legal age, which is 21 years or older. In the US there is usually no age cutoff, meaning you can adopt as long as you are 21 or over.

Three States (Colorado, Delaware, and Oklahoma) and American Samoa set the age at 21; and Georgia and Idaho specify age 25. In Puerto Rico, the adopting parent must be at least 14 years older; in Idaho, the parent must be at least 15 years older. All other states do not specify a minimum age to be eligible to adopt.
In six states, including Washington, Tennessee, Kentucky, Louisiana, New Jersey and Montana, the adopting parents must be at least 18 years old. In three states, including Delaware, Colorado, and Oklahoma, the adopting parents must be at least 21 years old.
Most states require that adoptive parents be at least 18 years of age with a set minimum age difference between the child and adoptive parent(s). At least one parent must be a citizen of the U.S. in order to adopt a child into a U.S. family.
Domestic Adoptions. In the past, the upper age limits for adopting parents followed by domestic private agencies was set by a 40-year rule of thumb: adopting parents shouldn't be more than 40 years older than the child they wanted to adopt.
Today, at 41 and 55 years old, respectively, they are considered by most adoption agencies to be too old to raise a newborn in the United States. Even abroad, certain countries place age limits on adoptive parents.
